Financial technology (FinTech) is a hybrid of the technology and financial services industries. It uses technology to innovate how goods and services that are typically provided by financial institutions are delivered. By combining the legal, business, and operational aspects of FinTech through his extensive experience as a practising lawyer, board member of a bank, and of a publicly traded technology-based company, the author writes on this new area of law and business that spans domestic and international jurisdictions.

This book walks you through the world of finance, covering both conventional and Islamic banking, while also explaining the background and analysing the relevant laws, such as;

  • the Capital Markets and Services Act 2007,
  • Securities Commission guidelines,
  • Central Bank legislation,
  • the Financial Services Act 2013,
  • the Islamic Financial Services Act 2013,
  • the Anti-Money Laundering,
  • Anti-Terrorism Financing and Proceeds of Unlawful Activities Act 2001 (AMLA)
  • the Companies Act 2016,
  • the Contracts Act 1950 and also related legislation in Asia, Europe and the United States.

Without leaving any detail out, the author starts the book with a history lesson on finance before moving on to where it is today, with FinTech disrupting the financial sector with technology. He then goes into great detail about the operational and legal aspects of banking and finance before moving on to capital markets and concerns about money laundering. By illustrating FinTech acquisitions and teaching about takeovers and due diligence, mergers and acquisitions and corporate law are addressed. The technical features of online banking are then covered, spanning several countries. He works with Islamic FinTech, E-waqf, and Takaful insurance due to his knowledge in Islamic finance. He also discusses cyber security and the various pieces of legislation that pertain to it. The book concludes with a chapter on the internet of things and smart contracts that provides a thorough analysis of the legal ramifications of these topics as well as suggestions for the future.
