Description of Private International Law in English Courts, 2nd Ed:

The first edition of this book provided an overview of European and English private international law as applied in English courts. However, the UK's decision to leave the EU, coupled with the EU's refusal to allow the UK to rejoin the Lugano Convention, necessitated significant changes to the book’s structure to reflect the new legal framework, which in some respects is more outdated. As the complexities of the separation are worked through, it is evident that the law has lost some of the coherence it once had. Whether these inconsistencies can be resolved, and how, remains to be seen. This updated edition seeks to explain and analyze the current state of affairs, acknowledging that the system does not always function smoothly.

The book offers critical insights and guidance, both pre-litigation and during proceedings. Authored by an academic and practising barrister with over four decades of experience, it provides an updated perspective on private international law as it stands six years after the national referendum, much like the previous edition did for the hybrid system of English and European law before Brexit. Understanding the law's pre-Brexit state is essential to grasp the implications of the new legal landscape.
